Reissuing Powers of Attorney

MICEX SE Traders: Stock and Derivatives Markets

The MICEX Stock Exchange CJSC (hereafter — MICEX SE) hereby gives notice that if the validity period of powers of attorney previously given by the MICEX SE for performing operations in the MICEX SE stock and derivatives markets expires, it is necessary to submit the following documents to the MICEX SE Stock Market Department Trader Relations Sector:

If it is necessary to extend powers of attorney for representatives of the Trading Participant who are given Trader’s authorities, please provide the MICEX SE with a power of attorney according to the form stipulated in Annex No. 5 to the Regulations on Admission to Participate in Trading (hereafter —Admission Regulations).
If it is necessary to accredit a new Trading Participant’s representative as a Trader, in addition to submitting the above-mentioned power of attorney, you must submit documents confirming the qualifications of that specialist in accordance with the Admission Regulations.
If it is necessary to extend powers of attorney for representatives of Trading Participants delegated with Supervisor and/or Analyst authorities and/or authorities to receive reports on the results of trading on the MICEX SE through Back-Office, please submit powers of attorney to the MICEX SE:
- for Supervisors, according to the form stipulated in Annex No. 6 to the Admission Regulations;
- for Analysts, according to the form stipulated in Annex No. 7 to the Admission Regulations
- for receiving reports on the results of trading on the MICEX SE through Back-Office, according to the form stipulated in Annex No. 8 to the Admission Regulations.

If it is necessary to extend the document authorizing representatives of the Trading Participants to receive reports which are formed in accordance with the Regulations on Securities Trading in the MICEX Stock Exchange Closed Joint Stock Company (hereafter — Trading Regulations), please provide the MICEX SE with the List of Authorized Persons according to the form stipulated in Annex No. 13 to the Trading Regulations.
Note: No more than 5 persons (including traders and couriers) can be included on the list for each organization.

The term of the delegated authorities for these representatives shall not be longer than 3 years.
If it is necessary to extend powers of attorney for an authorized person, please provide the MICEX SE with a power of attorney according to the form stipulated in Annex No. 5 to the Agreement on Providing Integrated Technological Services.
If it is necessary to extend powers of attorney for performing Remote Workstation Administrator functions, please provide the MICEX SE with a power of attorney according to the form stipulated in Annex No. 6 to the Agreement on Providing Integrated Technological Services.

MICEX SE Derivatives Market:

If it is necessary to extend powers of attorney for representatives of the Trading Participant given Trader's authorities, please provide the MICEX SE with a power of attorney according to the form stipulated in Annex No. 10а to the Regulations on Admission to Participate in Trading in the Derivatives Market (hereafter — Regulations on Admission to the Derivatives Market).
If it is necessary to accredit a new Trading Participant’s representative as a Trader, in addition to submitting the above-mentioned power of attorney, you must submit documents confirming the qualifications of that specialist in accordance with the Regulations on Admission to the Derivatives Market.
If it is necessary to extend powers of attorney for Trading Participants’ representatives given Analyst and/or Courier’s authorities, please submit powers of attorney to the MICEX SE:
- for Analysts, according to the form stipulated in Annex No. 10c to the Regulations on Admission to the Derivatives Market;
- for Couriers, according to the form stipulated in Annex No. 10d to the Regulations on Admission to the Derivatives Market.

The Organization / MICEX SE Trading Participant independently controls the expiration of the validity period of the powers of attorney for its representatives in the MICEX SE stock and derivatives markets and can revoke the powers of attorney from the MICEX SE when such persons forfeit their authorities.

When issuing powers of attorney, please take into account the requirements stipulated by the Russian Civil Code (Articles 185–189):

The power of attorney’s validity period cannot exceed three years. If there is no period stipulated in the power of attorney, it is effective for one year beginning on the day of its execution;
A power of attorney with no indication of its execution day is null and void;
The power of attorney given in the transfer must be notarized;
The validity period of the power of attorney given in the transfer must not exceed the validity period of the power of attorney on the basis of which it is given.

For organizations that have not joined the MICEX Electronic Document Circulation System, it is essential to complete the admission procedure.

Please note that when reissuing powers of attorney for traders who have registered technological identifiers (“gateways”) for other employees, you must provide Official Letters on Providing Technological User Identifiers to work from remote workstations through the EPTF.

If any of the above-mentioned types of powers of attorney has already been executed and its validity period extends to 2009, it is not necessary to re-submit that power of attorney to the MICEX SE.

In the absence of reissued powers of attorney, permission for organizations and their representatives to perform operations in the MICEX SE stock and derivatives markets will be suspended beginning on the expiration date of the powers of attorney.
